Onshore Partner Visa (Subclass 820/801)

The Partner Visa (subclass 820/801) enables the De Facto partner or spouse of an Australian citizen, Australian permanent resident, or eligible New Zealand citizen to live in Australia.

It involves a two-step process, starting with the temporary 820 visa, which allows the applicant to reside in Australia. After two years from lodging the 820 visa application, the applicant can apply for the permanent 801 visa for long-term residency.

This visa is available for married or de facto partners (including same sex partners)and is applied for within Australia.

Eligibility

Genuine Relationship: You must be in a genuine relationship with an Australian citizen, permanent resident, or eligible New Zealand citizen. Couples in the same sex marriage or de facto relationship may also consider applying for this partner visa.

Onshore Application: You must be in Australia when applying for the Partner Visa (820/801).

Age Requirement: Most applicants must be 18 years old or over.

Eligible Sponsor: You must have an eligible sponsor who is not barred from sponsoring you.

De Facto or Marriage Requirements: You must meet the requirements for a de facto or marriage relationship.

Relationship Evidence: You need to provide sufficient evidence to support the genuineness of your relationship.

12-Month Requirement (De Facto Relationships): Unless eligible for a waiver, you must have lived together with your partner for at least 12 months.

Health and Character Requirements: You must meet Australia's health and character requirements.

Visa History: You should not have had a visa cancelled or an application refused.

Other Visa Requirements: You must satisfy all other visa requirements specified by the Australian Department of Home Affairs.
