About the Subclass 461 Visa
The New Zealand Citizen Family Relationship visa is a five-year temporary visa for eligible family members who are neither Australian nor New Zealand citizens. It can allow you to live, work and study in Australia with a qualifying New Zealand citizen family member.
Who is the pathway for?
The usual pathway requires membership of the family unit of a New Zealand citizen who is not an “eligible New Zealand citizen” for migration purposes. That person must hold a subclass 444 Special Category visa in Australia, or travel with you and be eligible to receive one on entry. A New Zealand passport alone does not establish the required Australian visa status. Partners and eligible dependent children may qualify, subject to the family-unit rules.
How does 461 differ from a partner visa?
A 461 is temporary and does not itself provide an automatic permanent residence stage. An Australian citizen, Australian permanent resident or eligible New Zealand citizen partner may instead be able to sponsor an eligible 820/801 or 309/100 application. We check the New Zealand citizen’s current status before comparing pathways. Becoming an Australian citizen can change the appropriate future application.
Family relationship and supporting documents
The documents depend on whether you apply as a spouse, de facto partner or dependent child. Relevant evidence may include passports, the New Zealand citizen’s visa record, marriage or birth certificates, relationship history, shared living arrangements and dependency. For children, parental consent and custody arrangements may also need review. We provide a tailored checklist and help explain missing records or periods of separation.
Where you apply and visa conditions
You can apply in or outside Australia, subject to the relevant criteria. Onshore applicants need a careful review of their current and previous visas, no further stay conditions and any additional criteria for people without a substantive visa. Applicable health, character and government-debt requirements must be addressed. Health insurance is recommended; check any separate Medicare or reciprocal healthcare entitlement.
Further applications and relationship changes
A further 461 grant requires a new assessment; renewal is not automatic. Certain former family members may still qualify under specific criteria after relationship breakdown, including restrictions about joining another family unit and additional requirements for applicants overseas. Obtain advice before the current visa expires or assuming a separation prevents another application.
Our immigration lawyers assess eligibility, compare alternatives, organise evidence and respond to Department requests. We also help plan timing where your New Zealand family member’s status is changing. Fees and processing times vary. Read current Home Affairs guidance.
Am I Eligible?
Eligibility criteria for subclass 461
Family Unit
Be an eligible spouse, de facto partner or dependent family member of a qualifying New Zealand citizen.
Qualifying New Zealand Citizen
The family member must satisfy the relevant subclass 444 and subclass 461 status requirements.
Relationship Evidence
Provide documents explaining the family relationship, including marriage, birth, dependency or shared-life evidence as appropriate.
Partner Relationship
For spouses and de facto partners, demonstrate a genuine relationship and satisfy the applicable family-unit requirements.
Health and Character
Meet the applicable health and character requirements for each applicant.
Dependent Children
Review dependency, custody and parental consent where relevant.
Immigration History
Check current and previous visas, no further stay conditions and additional onshore criteria before lodgement.
Identity and Visa Status
Confirm the New Zealand citizen’s identity and qualifying subclass 444 status.
Your Journey: Applying and Planning Ahead
1. Assess Your Pathway
Confirm the New Zealand citizen’s visa status, your family relationship and whether a partner visa or subclass 461 is appropriate.
2. Prepare the Evidence
Gather identity, status, relationship and dependency documents and address any gaps before applying.
3. Lodge and Respond
Prepare the application and respond to Department requests. Onshore applicants should review their current visa and any bridging conditions.
4. Understand Your Grant
A 461 normally allows five years in Australia with work and study rights. Check the grant notice, travel validity and separate healthcare entitlement.
5. Keep Details Current
Tell Home Affairs about relevant changes. Obtain advice promptly if the family relationship or New Zealand citizen’s status changes.
6. Plan a Further Application
Another 461 requires a new assessment. Review continuing or former family-member criteria before expiry; there is no automatic permanent stage.

The New Zealand Citizen Family Relationship visa is a five-year temporary visa for eligible family members who are neither Australian nor New Zealand citizens. It can allow you to live, work and study in Australia with a qualifying New Zealand citizen family member.
Application stages
1. Check the New Zealand family pathway
Confirm the New Zealand citizen’s relevant subclass 444 status or eligibility, and whether the applicant qualifies as a member of their family unit. Subclass 461 is different from Australian citizen/permanent resident partner sponsorship and the 820/801 or 309/100 pathways.
2. Lodge the 461 application
Provide identity, family relationship, the New Zealand citizen’s status, and applicable health and character evidence using the prescribed application process. This is a temporary family visa application; there is no employer nomination or paired permanent partner stage.
3. Decision and conditions
Check the grant notice and individual conditions. A 461 visa generally permits a five-year stay, work and study, but it does not itself confer permanent residence. Lodgement, location and any bridging visa consequences need individual checking.
4. Further visa before expiry
A further 461 visa requires a new application and satisfaction of the relevant criteria. Relationship changes can affect the applicable further-visa requirements. Renewal and permanent residence are not automatic.
